Sentence as to Counts 1, 9, 10 and 11 of the Fourth Superseding Indictment- Imprisonment-10 Months as to each Count, with all terms to run concurrently. Defendant's Oral Motion to Self Surrender at the Prison Facility designated by the Bureau of Prisons-Granted. Mittimus Stayed to January 13, 2003 by 2:00 p.m. (Local Time of Prison Facility) Court recommends Prison Facilities-1. Dublin, Oregon 2. Phoenix Supervised Release-3 Years as to Counts 1, 9 and 10 and 1 year as to Count 11, with all terms to run concurrently. Special Conditions of Supervised Release- 1.That the defendant shall abide by the standard conditions of supervision. 2.That the defendant not commit any crimes, federal, state, or local (mandatory condition). 3.That the defendant not possess illegal controlled substances (mandatory condition) 4.That the defendant shall refrain from any nlawful use of a controlled substance. The defendant shall submit to one drug test within 15 days of release from imprisonment and at least two drug tests thereafter, as directed by the Probation Office (mandatory condition). 5.That the defendant is prohibited from possessing a firearm as defined in 18 U.S.C. 921. 6.That the defendant is prohibited from possessing any illegal or dangerous weapons. 7.That restitution of $25,000 is due immediately and any remaining balance upon release from confinement be paid during the period of supervision on an installment basis according to the collection policy of the Probation Office but at a rate of not less than 10 percent of his/her monthly gross income. Interest, if applicable, is waived while the defendant is serving his term of imprisonment and shall commence to accrue on any remaining balance upon her release on supervision. 8.That the defendant provide the Probation Office and the Financial Litigation Unit of the U.S. Attorney's Office access to any requested financial information to include submitting to periodic debtor's examinations as directed by the Probation Office. 9. That the defendant cooperate with the Internal Revenue Service (IRS), in the filing of all past due tax returns and payment of all taxes. 10.That the defendant shall submit his or her person, residence, place of employment, or vehicle to a search conducted by the U.S. Probation Office at a reasonable time and in a reasonable manner, based upon reasonable suspicion of contraband or evidence of a violation of a condition of release. Failure to submit to a search may be grounds for revocation. The defendant shall warn any other resident that the premises may be subject to search pursuant to this condition. 11.That the defendant perform 2,500 hours of community service as directed by the Probation Office.
